V takov\u00e9m p\u0159\u00edpad\u011b je uzav\u0159ena smlouva o d\u00edlo nebo smlouva o poskytov\u00e1n\u00ed slu\u017eeb, ale ve skute\u010dnosti jsou p\u0159\u00edtomny v\u0161echny faktory skryt\u00e9ho poskytov\u00e1n\u00ed pr\u00e1ce.<\/p>\n<p>To je velmi riskantn\u00ed jak pro firmy, tak pro zam\u011bstnance. P\u0159i nedodr\u017eov\u00e1n\u00ed z\u00e1konn\u00fdch ustanoven\u00ed to vede ke zna\u010dn\u00fdm probl\u00e9m\u016fm pro ob\u011b strany. Ti za svou pr\u00e1ci dost\u00e1vaj\u00ed odm\u011bnu, ani\u017e by c\u00edlem smlouvy bylo vyl\u00e9\u010den\u00ed nebo vyhran\u00fd soudn\u00ed spor.<\/p>\n<p>V p\u0159\u00edpad\u011b pron\u00e1jmu zam\u011bstnanc\u016f je zam\u011bstnanec d\u00e1n k dispozici spole\u010dnosti. Probl\u00e9mem pro mezin\u00e1rodn\u00ed spole\u010dnosti je, \u017ee mus\u00ed dodr\u017eovat jak n\u00e1rodn\u00ed z\u00e1kony, tak evropsk\u00e9 a mezin\u00e1rodn\u00ed p\u0159edpisy.<\/p>\n<h3>Po\u017eadavky specifick\u00e9 pro danou zemi<\/h3>\n<p>Je nap\u0159\u00edklad d\u016fle\u017eit\u00e9 si uv\u011bdomit, \u017ee mnoho zem\u00ed m\u00e1 r\u016fzn\u00e9 po\u017eadavky na povolen\u00ed a registraci do\u010dasn\u00fdch pracovn\u00edk\u016f.<\/p>\n<p>Vezm\u011bme si nap\u0159\u00edklad Francii. V N\u011bmecku se jednozna\u010dn\u011b klade d\u016fraz na to, zda je zam\u011bstnanec v\u00e1z\u00e1n pokyny.
