Frequently asked questions

Subcontractor posting occurs when a company (the main contractor) outsources part of its tasks and services to another company (the subcontractor), which in turn sends its own employees (the posted workers) to the country of the main contractor or a third party to carry out these tasks.
When posting subcontractors, the posting regulations of the respective countries must be observed. These include rules on minimum wage, working hours, social security obligations, occupational safety, and accommodation. In the EU, for example, the EU Posting of Workers Directive applies.
The objectives of posting are often cost savings through wage differences, the use of special expertise or resources of the subcontractor, greater workforce flexibility, and expansion into new markets.
Compliance with working conditions is often ensured by the legislation of the host country. Employers must adhere to local regulations and may be subject to labor inspections. In addition, there are reporting and documentation obligations to prove compliance with the standards.
The main contractor is often obliged to check whether the subcontractor complies with legal requirements. This can include reviewing working conditions, insurance coverage, and compliance with reporting obligations. Sometimes the main contractor is also liable for violations committed by the subcontractor.
Yes, within the EU, harmonized regulations such as the EU Posting of Workers Directive apply, which are binding for all member states. For postings to third countries, the national regulations of the respective country apply, which can vary greatly.
Violations of posting regulations may result in fines, back payments of wages and social contributions, or other criminal consequences. It may also lead to exclusion from public contracts.
As a rule, posted workers remain covered by social security in their home country, which in the EU is proven by forms such as the A1 certificate. However, there are agreements between countries that regulate social security coverage and prevent double insurance.
This depends on the duration of the posting and the tax treaties between the home country and the host country. As a rule, there is a threshold (e.g. 183 days within a year) under which employees remain subject to taxation in their home country.
False self-employment refers to the issue of workers being declared as self-employed, even though they actually work like employees. This can occur in the posting of subcontractors to circumvent social security contributions and labor law regulations.
