Employee leasing in the construction industry in Germany is subject to special rules and regulations. Employee leasing through a temporary employment agency into the main construction trade is prohibited under § 1b AÜG.
Employee leasing is prohibited under § 1b AÜG insofar as it concerns commercial workers carrying out construction activities. This means that classic temporary employment agencies are not permitted to lease workers such as bricklayers or roofers. Employee leasing is only permitted if it is carried out between companies within the construction industry. For example, a roofing company may only lease personnel to another roofing company.
